“A New Kind of Lawsuit,” Restaurant News [2009-09-22]
If your managers and supervisors are bored with the annual training on how to avoid discrimination claims from disgruntled employees and job applicants, perhaps this will interest them: Courts are increasingly awarding monetary damages in cases against individual restaurant employees for employment discrimination. This means that managers could be responsible for tens or even hundreds of thousands of dollars in damages if found liable.

“Age discrimination complaints, concerns increasing,” AH&LA SmartBrief 04/27/2009
Age discrimination appears to be on the rise, and senior-level executives are growing increasingly concerned about it. A recent ExecuNet survey found that 44% of senior-level executives felt their age would affect their ability to find their next job -- up from 33% last year. The Equal Employment Opportunity Commission registered more than 24,000 charges of age discrimination and recovered $82.8 million in benefits in fiscal 2008, up from 19,103 charges and $66.8 million recovered the previous year.

“The witnesses' testimony (before a panel of EEOC officials) demonstrated ‘first and foremost, the devastating impact that age discrimination can have on a person.' And he added that ‘age discrimination is an equal opportunity plague. It is not limited to members of a particular class or a particular race. It is not limited to particular industries or particular regions. And it is not limited to a particular gender.” Stuart Ishimaru, acting EEOC chairman, from a hearing July 15, 2009.
